You are breaching social protocol.
I did not invite nor solicit an encounter with you. Most likely I have attempted to maintain the minimum of 6' and social distance and you may have continued to breach that distance even when I attempt to retreat or maintain that distance.
I have politely informed you of this link, verbally, handed you a card, or wrote on a piece a paper this link. Why? I prefer to not engage with a stranger. I don't know you, and you don't know me.
I am under no obligation to engage with you, respond to you nor explain anything to you.
However, I am giving evidence to me being a reasonable person, prepared to encounter people who would potentially be unreasonable or stretch beyond societal norms or make unlawful statements to me. If you don't leave my presence, I am telling you that I am being placed into duress, through intimidation of authority.
I am a law abiding citizen.
I abide by laws which have lawfully been passed through legislation.
Wearing a mask is not a "law". It is a directive by an authority which did not have the support of a legislative body vote. However, it is a demand which is tied to penalties for non-compliance.
The terms of the mandate, provide for an "exemption" for those who cannot "medically tolerate" the use of a mask.
I am under no obligating to provide personal, private, protected health information to anyone other than those who are in my direct medical care and are specifically HIPAA covered entities and comply with the Americans with Disabilities Act.
I, and my medical team can specifically , and categorically, state that "I CANNOT MEDICALLY TOLERATE A MASK OR FACE COVERING". My care team has documented evidence of my health and stand ready to confirm this if my rights are infringed or violated by any private citizen, or other individuals with either sworn authority or represent such authority.
I caution those who may choose to take actions in violating my civil rights, discriminate or even perpetrate a criminal act against me such as moving my private person, causing a disturbance, impeding my movement, falsely imprisoning, making a false report or kidnapping me.
These are all Deprivations of my Rights and are unlawful.
I additionally, have an accommodation/exemption based upon ADA. As an individual, you are not protected entity according to HIPAA and I am not obligated to disclose anything to the establishment, you or the police. I also note that Law Enforcement are not HIPAA covered entities and cannot lawfully demand of a citizen personal, protected, private, health information.
I have no power when a citizen makes unlawful choices other than civil remedies.. But I do have a sense of duty to make them aware that they are being unlawful.
Please dis-engage from me.
Depending upon your decisions or actions against myself will determine my response. If you continue to engage, I will document your conduct as harassment and any other civil violations against my self per 42 USC 1983 and possibly 18 USC 242&243.
Instead of engaging me you have other options.
You may go to the establishment's management/supervisor and seek to converse with the company's ADA coordinator. A company which employs more than 50 people is obligated to have an ADA coordinator in accordance with ADA law.
If that is not the direction you desire, you might want to speak to a law enforcement officer to determine when it is unlawful to wear a mask.
I caution you if you choose to contact law enforcement that you not create a public record of false information. That would be a criminal offense and I will certainly obtain all the pertinent details of a call as afforded by the Commonwealth Right To Know Law to seek redress.
Have a great day.
Bless your heart.
If you are not sure what to do, call the Po-Po.
If you choose to move forward violating my rights, I will require you to specifically identify your reasoning to violate me, and your name so we can resolve this issue inside a court of law.
